Move to address 'illegalities' identified by European General Court in recently annulling five-year duties on truck and bus tires

Brussels - The European Commission has decided to re-open its anti-dumping and anti-subsidy investigations concerning imports of truck and bus tires from China into the EU.

The Commission’s decision will address “illegalities” identified by the European General Court in recently annulling five-year duties, which the EC had placed on these imports on 4 May 2018.

The decision, issued 7 July, to reopen the case means imports of “certain pneumatic tires, new or retreaded for buses or lorries originating in the People’s Republic of China" are subject to registration. 

On 4 May, the European General Court ruled that the EC’s anti-dumping and countervailing duties imposed on imports of truck and bus tires from China must be annulled.

In its ruling, the court found that the Commission had failed to carry out fair price comparison in its calculation of price undercutting.

The case was brought by the China Rubber Industry Association and China Chamber of Commerce of Metals, Minerals & Chemicals Importers & Exporters in early 2019.
